    Terms & Conditions

    Last Updated: JUNE 2026

These Terms and Conditions govern all SMS messages sent and received as part of the commercial electronic messaging services provided by BDL Systems. These terms are subject to and incorporate the requirements of the Spam Act 2003 (Cth), the Privacy Act 1988 (Cth), and all applicable regulations enforced by the Australian Communications and Media Authority (ACMA). Your use of this service constitutes acceptance of these terms.

    1. Consent

BDL Systems will only send you commercial electronic messages where we have obtained your prior consent, either express or inferred, in accordance with the Spam Act 2003 (Cth) and the ACMA Statement of Expectations (July 2024). Express consent means you have clearly and actively opted in to receive messages from us. Inferred consent may apply where you have an existing business relationship with us and the messages are relevant to that relationship. You may withdraw your consent at any time using the opt-out method described below.

    2. Sender Identification

Every SMS message sent by BDL Systems will clearly identify BDL Systems as the sender, in compliance with the Spam Act 2003 (Cth). Where we use an alphanumeric Sender ID, it is registered with the ACMA SMS Sender ID Register in accordance with requirements effective December 2025. This ensures all messages can be traced to BDL Systems and protects you from fraudulent impersonation.

    3. Message Content

Messages sent by BDL Systems may include alerts, reminders, promotional offers, service updates, and other relevant communications. All message content will be truthful, accurate, and not misleading, in accordance with the Australian Consumer Law and the Spam Act 2003 (Cth). The frequency of messages will depend on your interaction with our services and your stated preferences.

    4. Opt-Out Instructions

You may withdraw consent and discontinue receiving messages from BDL Systems at any time by replying STOP to any of our messages. This will unsubscribe you from our SMS communications at no cost to you. We will process your opt-out request within five (5) business days, in compliance with the Spam Regulations 2021 (Cth). You will not be required to provide personal information, create an account, or incur any fee to unsubscribe. Once opted out, BDL Systems will not send you further commercial electronic messages unless you provide fresh consent.

    5. Privacy and Data Handling

BDL Systems collects and handles your personal information, including your mobile number, in accordance with the Privacy Act 1988 (Cth) and the thirteen (13) Australian Privacy Principles (APPs). Your personal information will only be used for the purpose for which it was collected and will not be sold to third parties. We take reasonable steps to protect your data from misuse, loss, and unauthorised access. Our full Privacy Policy, which outlines how we collect, use, store, and disclose your personal information, is available on our website.

    6. Message Delivery

BDL Systems does not guarantee that messages will be delivered without delay or failure. Such issues may arise from factors outside our reasonable control, including network outages, carrier limitations, or device compatibility issues. BDL Systems accepts no liability for losses arising from delayed or undelivered messages where the cause is beyond our control.

    7. User Obligations

By using this messaging service, you agree to provide accurate contact information and to notify BDL Systems promptly if your mobile number changes. You must not use this service in any manner that is unlawful, offensive, or intended to harass or harm others. You acknowledge that misuse of this service may result in your access being revoked.

    8. Compliance with Australian Law

This service operates in full compliance with applicable Australian legislation, including but not limited to: the Spam Act 2003 (Cth), the Privacy Act 1988 (Cth), the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), the Telecommunications (Consumer Protection and Service Standards) Act 1999 (Cth), and all relevant ACMA determinations and guidelines. BDL Systems will cooperate fully with any ACMA investigation or enforcement action.

    9. Changes to These Terms

BDL Systems reserves the right to amend these Terms and Conditions at any time. Where changes are material, we will communicate updates via our website or through direct communication where reasonably practicable. Continued use of the service following notification of changes constitutes acceptance of the updated terms.
